tip: my so called "public defender" told me to plea out and said that if the cops arrested me the judge will assume I'm guilty. When I was arrested the cop told me by law he must arrest someone and that I'm guilty. Basically if you are too poor for a lawyer everyone will lie to you and try to screw you over and get you caught up in the legal system. Don't take any pleas! Demand a speedy trial (you have to file a motion for this) and ask for a trial by jury. Don't let the public defender manipulate you if you have one. A good lawyer would have the case dismissed if you have money. That is assuming its similar to my situation where there was no real evidence and I called the cops and reported the incident.

I have almost the same experience where I called the police about someone attacking me, I leave then two hours later the police show up and talk to the other guy (my dad) then come and arrest me. They told me "he has a black eye how can you explain this? Am I supposed to believe he did it to himself?" I was like I don't know he must of because I didn't give him one. "Well we got pictures". After I was arrested I saw the picture. The "black eye" was a slight red mark on the side of his face that could come from anything. I really feel ashamed of the conduct of a lot of police officers.

Also the only thing on my record and now from 10 years ago and I'm also going to school for teaching. It depends on the state. I wasn't found guilty because I did a plea bargain in which adjudication was withheld so I can have it sealed from my record. However when I tried to join the army they considered the fact that I did probation for it as being the same as admitting guilt, despite the fact it is in court record that before I made the plea I specifically stated that I was not guilty and would not admit guilt and that if I had to admit guilt in order to take the plea I would not do it. Yet somehow they consider that I admitted guilt.

Board of education says I will have to go before them and explain the situation and get a waiver before I can teach, though it should not be a problem given the mitigating circumstances. The main factor here is that it happened so long ago and I have no other arrests or anything. If it is recent it might weight against you a lot more.

It's the same thing with getting it sealed from the record. Generally they want 10 years or more to go by (and not being found guilty) before it can be sealed.

My neighbors Warranty Deed has our lot number description on his deed and our Waranty Deed is correct with our lot number description. We just found out because we were trying to get out a loan using our home as collatoral and we are now finding out that because someone typed and error ( a 4 instead of a 9 ) on our neighbors Deed, this is clouding our title. How can this be corrected. All our papers are in order. It is our neighbors papers who have the error, yet the title company is telling us we have to take care of this by going to a lawyer. Why do we have to correct this if our papers are in order?

no - I have a deferred sentence and I thought I had a job with wal-mart - because they do hire felons. Both my interviews went well & they wanted to put me to work ASAP, but they couldnt because of the background check, which I was upfront with, shows a 5 year deferred sentence. Its easier to get out of prison and get a job than it is to find one with a deferred sentence.

I realize that you were searching for an answer two years ago but I thought I would tell you what happened to us also in case this situation ever happens to anyone. This same scenario happened to my husband TWICE! Both times he was "on probation" at work pending the investigation. These probation periods lasted over 30 days because we would always appeal the decision since their investigation always led to the same result that my husband was the man in texas with the criminal record. During that time my husband would not get paid and you can imagine how difficult it is to live with no income for over a month. Needless to say by the time the second background investigation started I had already started the company that was doing the investigation to explain to them what had happened before. Every time I was talking to a different person and had to keep repeating the story over and over. Nothing was getting done. After the first 30 days we got the decision that my husband was the one with the criminal record and my husband was let go from his job. I then took action. I got a copy of their findings and contacted the police department of Texas (where the other man resided) and went online and because his crimes were all public record I bought his criminal report for $6.00 This included a list that was identical to the list that was on my husbands report and it also included a very lovely mug shot of the other man. I made sure to print this in color multiple times as well as making enlarged copies of my husbands drivers license and a copy of his report so that the difference was obvious. In a one day turn around, my husband had his job back and never questioned again about any criminal activity. Now our problem is that even though the texas man and my husband share same name and birthdate they do not share the same social security number but somehow... the texas mans information is in my husbands credit report. WHAT A DRAG! Now I'm trying to figure out how to fix this as fast as possible.

actually..richard knows next to nothing about whats happening. See, your case is in "pause" mode. While you complete your probation and/or any other programs that have been court orered, the courts actual judgement reamins unceratin until youve completed your probation. They can not enter a "conviction" on your record, because the case is still pending judgement, a la, you actually completeing the probation without further offenses.

Yes it will affect employment. To those people who say it won't, you obviously haven't had a DUI or looked for a job with one. You are pretty much looking at long-term unemployment.
Legally employers may not be able to hold an arrest against you or it shouldn't matter for non-driving jobs, but it most certainly does. They will hire or interview someone with a clean record first and you will have no "proof" to seek recourse.
Maybe when everyone knows someone who was not impaired but got a DUI (and with 1.5 million new DUI's every year that should be soon) it won't matter so much.
In this economy welcome to the criminal underclass.

I had the same thing happen. I was going 65 on a 50, coming going home from a trip to New Mexico. I live 12 hours away from the town that i was speeding in. Can I just settle the fines and what not through phone and mail? I really don't want to drive all the way back there.

If you marry someone who spent their way into bankruptcy, you are going to regret it. Chances are they are marrying you to get themselves out of poverty. I know a couple who recently went into bankruptcy. They decided to divorce and marry others for just that reason. I'll bet both of their partners are not aware of this. Watch your property!

Getting married is a two-step process.

YOU ARE NOT MARRIED UNLESS A LEGALLY ABLE PERSON SOLEMNIZES THE RITE OF MATRIMONY.

A marriage license is a legal document that tells the officiant no lawful impediments exist to the marriage. The license, which is only valid within a certain time frame that varies by state, must be completed and filed by the justice of the peace or clergyperson performing the ceremony.

You do not need to do anything except return the license -- which you legally had to do when you never married and the time period passed.

You are not married!!!!

I am not sure why folks do not understand the basics of the laws.

Another way of putting this... Unless you consent to be married clearly, then you are not married. A license is a critical piece of paper that records your consent. If consent is not there, then no marriage exists.

YES, obviously the people above have no clue what they are talking about. SIS (suspended imposition of sentence) means that successfully completing your probation means that you are not charged with a felony. As far as criminal records and guns go, if you are a convicted felon you cannot own a gun and if there has been any special court ordered stipulations then you cannot own a gun. If sentence for the felony you committed included SIS probation, and you completed it successfully you are not a felon and can own a gun. If you have committed other crimes which are felonies or have special court ordered stipulation then you cannot.

If you signed to Death Row you'd be living it up. Ruthless wasn't as big as the others.Bad Boy would be great but Jay-Z pisses me off. And at Aftermath you'd have to put up with that little bitch Eminem.

Would an arrest (no charges brought, case dismissed, because the complaintant lied to law enforcement and there was a lack of evidence proving reasonable cause for arrest/conviction) for DV affect one's chances of becoming an adoptive parent?

If youre going to be nasty or cant be adult enough to be tactful dont bother answering.

it is illegal. arrests cannot be a reason not to hire someone unless they can prove it is likely you really committed the crime AND they can show the crime you were arrested for and likely committed is substantively related to the job. though arrestees are not protected classes, the supreme court has held protected classes, such as blacks and latinos, are arrested at greater rates than other races because of discrimination. therefore, allowing discrimination against arestees is tantamount to discriminating against blacks and latinos. the EEOC discourages jobs from placing the question "have you ever been arrested" on applications because of the supreme court ruling. it is likely you have a law suit if they rescinded the job offer without a showing that it is likely you committed the crime (assault is probably substantively related to any job)

For the record - any infraction hasn't disappeared due to expunction. It means that the records are sealed - that means details cannot be released - doesn't mean there isn't a case file with your name on it. While I understand your desire to remain private, bottom line is be honest. Better to get it all out there than hide something that COULD be discovered later. If still in doubt - run it past a lawyer rather than the internet savvy. It's better to play it safe than fear the outcome.

Not 365 days in a year but 364. There are many other sources outside the canonized Bible that explain it all. Yes one of them does say, as the sayings of Christ, "Do not celebrate my birth but rather my death AND resurrection." Without the resurrection we have NO hope. This is told throughout the Gospels. In Deuteronomy 12:28-32 one may get the notion that God said, " do not honor me on pagan days." It is matter of fact about that also.

You should absolutely answer "no" to the question of whether you've been convicted of a crime - because you haven't been. To be convicted, you would have had to have been brought before a criminal court and found guilty. In this instance, you were just issued a ticket.

While turnstile jumping is a Class A misdemeanor in NY, the cops have the option of either arresting you for the crime or just issuing you with a fine. My understanding is that they typically only arrest people if they find that the person has had a prior criminal record. In your case, while this was a misdemeanor, the cops chose to simply give you a ticket for a civil offense. Also, while the ticket does set up a hearing date in the event you wish to dispute the charge, this hearing is before the "Transit Adjudication Bureau" - not a criminal court. Further, while the ticket states that payment of the fine will constitute relinquishing the right to a hearing and admitting liability for the fine, this does not mean that paying the fine makes you "guilty" of any crime. Only a criminal court with a right to trial before a jury can decide that.

As for your federal records, this wasn't a federal offense so there would be no federal record. Also, as stated above, because there was no arrest or conviction, it wouldn't be in your state record either.

In other words, just pay the fine and take it as a life's lesson.

Actually, I think not. I'm 15 currently. I also have a criminal record. Not proud of it, but hey it is what it is. Do not criticize someone for having a record at the age of 15. Everybody makes mistakes, I have learned from mine, and I also want my criminal record as I need it for personal reasons.

I was falsely arrested and accused of not responding to a warrant for my arrest (in time) for a NSF check from BJ's Wholesale. BJ's admitted to sending a certified notification of a warrant for my arrest for not paying them to my previous (wrong) address. I resolved check payment with BJ's and was not charged with anything.

Will this show on my record for my Govt security clearance?

I live in Scotland and I have been clean for more than 3 years. I am also a qualified nurse. So far I have been unable to commence a counselling course due to my criminal conviction. I have written to various charities and have had no luck either as you have to pass the enhanced disclosure check. Any suggestions would be much appreciated

In response to the woman who said "you don't have to have had cancer to be a doctor"- and "think about it."
But you can't have any kind of record and be a doctor- you just need to have come from a pretty stable background- where you were valued and encouraged. There are many of us who have not been so blessed. We are the nameless, faceless ones. We carry the weight of a hypocritical society that seems to think that if you break the law (get caught breaking the law) that you no longer have value. That is absolute and udder B.S. We have the right to be Drug and Alcohol councilors- and any thing else we qualify to do! We haven't lost our talents, intelligence, and abilities- because we got caught breaking the law; no more so than someone who becomes a Doctor and has, at some point broken the law, but was fortunate enough to not get caught. Now of course, I'm talking about misdemeanors here. Because when you get caught for a felony, you do lose some of your rights. But even that is for a limited time only. A criminal record was never meant to be held against someone for the rest of their lives. Not everyone who is convicted of a crime is a child molester or homicidal maniac. This country has gotten quite hypocritical and paranoid.

i was physically attacked by my sons girlfriend i called police she was jailed. aweek later the police show up at my door and arrested, jailed me for phone harrassment for 1 message i left for my son that was vulgar. she told them she was scared of what i might do. i am 43 and have never been arressted. this girl has spent numerous times in jail for beating up her own mother. she lied to the police and now i have an arrest record. OPrior to this i have signed up to Skagit college for a law enforcement course and i fear this arrest may ruin my career goals. do you know if it will? and if so can i have her arrested for lieing to police and having me spend the night in jail...a quite humiliating experience which also made me miss 2 appointments one i had been waiting for for a month with DVR and now i have to wait another month.

I might as well be your little sister (:
I was 13 last year , and got arrested at claires for shoplifting -____- from the clearance section for $7 worth ! The lady was a total BITCH to me , is it harrassment if she yells at me and swears at me ? I was bawling my eyes out and I regretted it SO MUCH . I still think about it , and the guilt eats me away . I was sooo stupid for shoplifting... but I totally learned my lesson . If I hadn't been caught , I probably would've kept doing it , I'm so stupid , but only after I was arrested I realized it ):

Wells yeah , I went down to the police department and it went on my record . My mom came to pick me up and she was speechless . My older sister (same thing as you) kept on telling me how stupid I was , which made me cry even more...

Generally , I am the down to earth , outgoing , nice girl that everyone gets along with . I have no attitude problem , and I get STRAIGHT A'S ... I didn't go court and wasn't convicted of anything because it was my first offense and I had a really good record . I have hundreds of certificates , I won an two art , writing , and poetry contect already . So they let me off , and I never brought up that day ever again . But it still lingers in my mind . Almost a year passed , and I really changed over that year . Your little sister and I are both REALLY lucky , unlike others who gets charged and go to juvi . Best of luck to her and I hope she learned her lesson like me <3

"Relict" is an archaic term for "widow" or "widower." "Jno" was a common abbreviation for "Jonathon," "Ja." is probably "James" (though "Jas." is more common), and I think BBL is "barrels," like "pp" is "pages."

A report, even naming you as an offender, has never been on our "record", also called a rap sheet. Only arrests and what happens to the case shows up.

Is there a record somewhere with you name on it? sure. All reports are kept for a certain length of time. Not something anyone outside of law enforcement can access and not anything any within law enforcement will access unless they are trying to build a case or search for someone.
