False record on file at the Clerk of Courts has costed me employment opportunities, do I have any recoarse?
I had a Domestic Violence charge back in 2001 that was reduced to a disorderly conduct, minor misdemeanor. I did not know until now that I had a record on file for the world to see until I needed to get a job. I have been turned down and lost job opportunities for the last year and have now lost my home to bankruptcy since I could not gain employment due to this record on file that is incorrect. The record on file says I was charged with a minor misdemeanor for Domestic Violence / Assualt when it actually should depict the true charge of disorderly conduct, minor misdemeanor. My question here is…Can I sue the Clerk of Courts for filing a wrongful conviction that has cost me everything? Any direction would be greatly appreciated – I am broke and can’t afford an attorney. Thanks
Sorry, I should have said the ORIGINAL charge was domestic violence / assualt and the one I agreed to was the AMENDED charge of Disorderly Conduct. The assualt was by the accuser and Disorderly was more in order for me since I DID NOT threaten or touch, just defended.

Well, if you were charged with Domestic Assault, but later plead guilty to disorderly conduct, then the record may well be accurate.

You were charged with domestic violence/assault, you were convicted of disorderly. Being convicted of disorderly doesn’t change the historical fact that you were originally charged with DV.

The charges stay on your record but the record will also say what your conviction is and that the charge was dismissed. My husband was mistaken for someone else and was picked up and charged with assault years ago. He was not convicted but the charge remains on his record as dismissed. He had to write an explanation of it when getting his license to deal gambling games. He was still hired. When you apply for a job that does a background check just explain this. The place I used to work could not even accept the lesser charge because it was with vulnerable adults but places like a casino might.
So the original charge stays on as a charge as far as I know. I am not a lawyer and don’t know anything other than what we have experienced. I wish you serenity
