I was arrested last year for disorderly conduct..my case was dismissed can army find it in my record if any ?

I signed the contact in the army and i said i was never arrested or charged, but i did when i was 16 for disorderly conduct but the case was dismissed and my attorney said it wouldn’t be on my record and they said they would keep a list of things i did i am now 17 , can the army find anything to find out that i lied and if so would i be discharged for that ?

    If they really want to check out your record they can easily find out because while your case was dismissed, the fact remains that you were arrested and charged. As to whether you can be discharged for that, it depends whether or not a record of arrest without conviction disqualifies you from joining the army. What nis more serious is your having given a false or untrue answer which could be interpreted as attempting to hide a bad record.

    I wouldn’t worry about it. The army needs all the kids they can get at this point. They will do a criminal background check, and will question you about it if needed.

    They will probably be more concerned that you lied. That is serious. Better to tell them about it and say you didn’t think it counted because it was dismissed. Good Luck.

    They will find out if you are in an MOS that requires a security clearance. The background investigator will talk to your friends, former classmates, acquaintances, etc. So, even if your arrest is not "officially" on your record, someone will still know of your arrest, and disclose it to the investigator. The failure to mention the arrest on your clearance application will be far more serious than the arrest itself.
