If a prisoner files1040-10&1040-20 courts can’t find records what happens?

This is in NYC prisoner filed these papers He is in for 2nd degree murder has done 13 yrs now 34 got 25-life very remorseful for his actions but can’t change it.It’s been 8 months since filed and they haven’t found them yet.
