LAST YEAR I GOT A DUI BUT MY LAWYER WENT TO COURT AND GOT IT DISMISSED. WILL IT STILL SHOW UP ON A BACKGROUND FINGER PRINT CHECK?

    Um, no.

    The case was dismissed. It never existed.

    And, if you are really concerned, why aren’t you speaking to a lawyer or a police officer instead of posting your question here of all places?

    Criminal records are linked by fingerprint, so the booking process you did will put this incident on your record. It will show a court case and a dismissal.

    What you should be looking to do is file a factual innocence motion. That’s the only way to get this completely off your record. If granted, it orders the police to destroy any record of the arrest and it totally wipes it from your record. Since you’re up in northern California, I’d suggest you contact Brian Dinday (he’s listed here on avvo.com) to discuss your case. He does a number of factual innocence petitions.

    yes and no… it depends on which record you are talking about. i am currently joining the military and have a criminal history, some adult, some juvie. i paid something like $25 to do a background check on myself and found that only my adult stuff showed up. there were 2 charges originally, and it showed both of those, then it showed that one charge was dropped and showed the other charge was amended. because none of my juvie stuff showed up, i didnt admit to it, but then my recruiter called me up and asked about a specific night and if i had been arrested. he had access to a better record than i could get. i was also informed that eventually they run you through the FBI database, and that lists everything, including if your name was just mentioned in a police report.

    The DUI will show up on ANY kind of criminal background check, but it will show up as being dismissed. It need not be listed on a job application. Most states allow you to have the arrest/charge expunged from your record providing it did not result in a conviction. If the arrest/charge is expunged, it will no longer show up on your record.

    Even if the charge was ‘dismissed’, as you say it was, the arrest itself for the charge may still show up on a background check. Sometimes you may have to petition for expunction of those types of records.

    Lots of people are unclear on what ‘dismissed’ means. They erroneously believe that if they plead guilty to a charge, are put on probation and complete that probation, the charge has been ‘dismissed’. Not true…..

    Talk to your lawyer again.

    Courts do not destroy records of anything. Whether someone will see that you have been charged depends on how deeply that person is looking, Most employers care only about convictions but the information will be at the courthouse for anyone who wants to see it.
