3 Responses to is it admissible in court to record someone without their knowledge in the state of texas?

  1. Jack C says:

If the subject has a reasonable expectation of privacy, such as in a private residence or workplace, then the recording will most likely be inadmissible.

If the recording was made in a public place, or at a party, and there was no expectation of privacy, then the recording might be admissible, depending on the circumstances.

  2. ashlee s says:

As long as one party knows its being recorded its admissible.

  3. Chris says:

It depends. Civil or Criminal? Would have to look to the specific procedure code and overcome any hearsay, authentication, or other objections to the introduction of the recording. If it is for a criminal case there may be other restrictions (i.e. 4th amendment) to protect the accused.
