My roomate had a Bong sitting out, and my landlord came through unexpectedly giving a house tour and saw his bong and now we are getting evicted (also the place was a mess). We aren’t going to court but he gave us 1 week to move out. If we comply with the eviction and move out without going to court, will the eviction be on our permanant record? Also, we have 1 month left on the lease, will we most likely have to pay for that month or just lose our deposit?
Thank you guys for all the answers. Many of you were wondering what state I am in and I live in Missouri and also another fact is our lease says no Paraphenalia, but we explained to him that one of the tenants likes to smoke his tobacco out of a water filter system. I have another place to move into for the last month, the only big concern is I didn’t want an eviction on my record, but it sounds like I won’t get one since we aren’t going to court (but it is a property company, not a solo guy).     No landlord can give you only one week to move out. If your lease is up at the end of the month, you have until the end of the month to move out.

    UNLESS there is something in your lease regarding this very issue. Read your lease. I don’t think your landlord can do this.

    However, he is under no obligation to continue to rent to you, so find somewhere new by the end of next month.

    you could argue over the last months rent, it may work. I am not sure what record you are talking about. Your credit report? Not if you lived up to your end of the lease.

    Legally your landlord must give you 30days notice for an eviction. Though if he’s overlooking illegal activity and not reporting you to the cops, you might want to just take it and go. And you’ll most likely still have to pay him and probably lose your deposit too. And if it’s renting directly from the owner its not likely going to be on your record but if your renting from a company or property management firm then it probably will

    What state do you live in? Most states require a 30 day notice to vacate. Even if you haven’t paid rent. They cannot evict you that quickly. Check with the magistrate for details! Some people do actually use ‘bongs’ or the proper term, water pipes, to smoke tobacco which is not illegal. What are his grounds for the eviction? Was the place messy or a health hazard? I am pretty sure he cannot evict you for being sloppy either. Again, check with the magistrate for your local laws. Sounds fishy to me.

    Edit: If he evicts you, you do not need to pay for the additional month. Even with ‘paraphernalia’ you still have to be given a certain amount of time.

    To EVICT you the landlord has to go to court. It is the court that would serve papers to have you evicted. If the landlord is saying ‘I am evicting you’, then he is not evicting you – he would be ‘trying it on’. If he does try to force you out, he will be breaking the law.

    He can give you NOTICE to leave with, usually, 2 months notice. If it less than 2 months to the end of the current contract, then you legally have until the end of current contract.

    Like the first answer wrote, he CANNOT tell you to move out at a weeks notice. That is ILLEGAL on his part.

    I honestly can not think of any reason why your eviction would go on any kind of permanent record except, *maybe*, your credit report–which I seriously doubt.

    If I knew what state you’re in, I could give you a more definite answer concerning rental laws and eviction. In California, for example, your landlord can not just enter the property without your permission unless he gives you or posts on the property a 24 hour notice; by law, even a rental property is for all intents and purposes *your* property.

    What does your lease say about drug use and keeping the house clean? If you signed a lease stating that such things as drugs and a ‘messy’ house are grounds for eviction, then you’re out, and there is little you can do.

    Since you *are* responsible for your own eviction–your friend’s bong or not, you are responsible as well, not to mention the fact that the house was a mess, something you can control–I am afraid you will probably have to pay off the remainder of the lease, unless he can find tenants between now and the end of the lease.

    You only have a month left, probably less now. Why worry about it?
